Terms of Service

These Terms of Service (“Terms”) constitute a legally binding agreement between you and [COMPANY_NAME](“we”, “us”, “our”) governing your access to and use of the Models Around Mewebsite and all associated services (collectively, the “Platform”).

By accessing or using the Platform in any way — including browsing, registering an account, posting a listing, or purchasing a Premium Membership — you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy and Cookie Policy, which are incorporated herein by reference.

If you do not agree to these Terms, you must immediately cease using the Platform.

We reserve the right to modify these Terms at any time. Continued use of the Platform after changes are posted constitutes acceptance of the revised Terms. See Section 13 for details on how we notify you of changes.

Throughout these Terms the following definitions apply:

Platform

The Models Around Me website, mobile-optimised site, associated APIs, and any related services operated by [COMPANY_NAME].

Model / Advertiser

Any individual who has registered an account on the Platform for the purpose of creating and publishing a profile listing advertising their services. By registering, a Model warrants that they are the person being advertised, or that they hold explicit written authorisation to advertise on behalf of that person.

Visitor / User

Any person who accesses or browses the Platform without holding a Model account, including members of the public viewing listings and individuals considering registering as a Model.

Content

All text, photographs, images, video, audio, data, and any other material uploaded, submitted, or otherwise made available through the Platform by any Model or User.

Listing

A public profile page created and maintained by a Model on the Platform that may include photographs, a description, contact information, service categories, rates, and location information.

Premium Membership

A paid subscription tier available to Models that unlocks enhanced visibility, additional photos, priority placement, and other features described in Section 7.

3.1 Minimum Age

The Platform is intended exclusively for adults. You must be at least 18 years of age to access or use the Platform in any capacity. In jurisdictions where the age of majority is higher than 18, you must meet that higher age requirement.

3.2 Models

In addition to the general minimum age requirement, any individual registering as a Model must be a legal adult under the laws of the jurisdiction in which they are ordinarily resident. Models who relocate must ensure they continue to meet local legal requirements for the activities they advertise.

3.3 Age Verification

We require age verification at the time of Model registration. Registrants must submit a government-issued identity document confirming their date of birth. We reserve the right to request additional verification at any time and to suspend or terminate accounts where age cannot be confirmed to our satisfaction.

3.4 Geographic Restrictions

We do not knowingly permit access to the Platform from jurisdictions where adult content directories are prohibited by law. By accessing the Platform you confirm that doing so is lawful in your jurisdiction. We make no representation that the Platform is appropriate or available in all jurisdictions.

4.1 Accurate Information

You must provide accurate, current, and complete information when creating an account and keep that information up to date. Providing false, misleading, or outdated information is grounds for immediate account termination.

4.2 Account Security

You are solely responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately at [COMPANY_LEGAL_EMAIL] if you suspect any unauthorised use of your account. We will not be liable for any loss or damage arising from your failure to protect your credentials.

4.3 One Account Per Person

Each individual may hold only one Model account. Creating multiple accounts to circumvent suspensions, bans, or Platform policies is prohibited and will result in termination of all associated accounts.

4.4 Non-Transferability

Accounts are personal and non-transferable. You may not sell, assign, or otherwise transfer your account or any rights associated with it to any third party.

5.1 Responsibility for Content

Models are solely responsible for all Content they post or publish on the Platform. We do not pre-screen Content before publication but reserve the right to review, modify, or remove any Content at our discretion. Publishing Content does not imply our endorsement of it.

5.2 Legal Compliance

You must ensure that your Listing and all activities it advertises comply fully with the laws and regulations of: (a) your country of residence; (b) the country where any advertised services are provided; and (c) the country of any person you engage with through the Platform. Ignorance of local law is not a defence.

5.3 Right to Offer Services

By publishing a Listing you warrant that you hold any licences, permits, or authorisations required by applicable law to offer the services described, and that offering those services in your location is lawful. We expressly disclaim any responsibility for verifying the legality of services advertised on the Platform.

5.4 Accuracy of Listings

Your Listing must accurately represent you and the services you offer. Misleading descriptions, impersonation, use of photographs of another person, or false claims about availability, pricing, or identity are strictly prohibited.

5.5 No Illegal Content

You must not post, upload, or otherwise make available any Content that is illegal under any applicable law. See Section 6 for the full list of prohibited Content categories.

The following categories of Content are strictly prohibited on the Platform. Violation of this section will result in immediate account termination and, where required by law, reporting to the relevant authorities:

• Content involving minors.Any sexual, suggestive, or exploitative content involving individuals under the age of 18, or any content that could reasonably be interpreted as depicting a minor. We operate a zero-tolerance policy and will report any such content to the relevant law enforcement agencies and to the National Center for Missing & Exploited Children (NCMEC) or equivalent authority.
• Non-consensual content. Images, videos, or descriptions depicting or referencing sexual acts performed without the consent of any person shown or described, including revenge pornography and voyeuristic content.
• Human trafficking. Any content that promotes, facilitates, or assists with human trafficking, forced labour, sexual exploitation, or any form of modern slavery.
• Illegal services. Advertising services that constitute a criminal offence in the jurisdiction where they are offered or received, including but not limited to the direct solicitation of sexual services where such solicitation is illegal.
• Fraud and impersonation. Content intended to deceive Visitors, impersonate another individual, or facilitate financial fraud of any kind.
• Hate speech and discrimination. Content that promotes, glorifies, or incites hatred, violence, or discrimination against any person or group on the basis of race, ethnicity, nationality, religion, gender, sexual orientation, disability, or any other protected characteristic.
• Content illegal under the model’s country of residence. Any material that is prohibited by the laws of the country in which you ordinarily reside, regardless of whether it may be lawful elsewhere.
• Malware and harmful code. Links, files, or scripts designed to damage, intercept, or gain unauthorised access to systems or data.
• Spam and unsolicited communications. Repeated or bulk messaging, fake engagement, or any form of unsolicited contact directed at other Platform users.

7.1 Features

Premium Membership gives Models access to enhanced features including, without limitation: priority placement in search results, increased photo upload limits, verified profile badge, and access to analytics showing profile view statistics. The precise feature set may change over time; the current feature list is displayed at the point of purchase.

7.2 Billing & Auto-Renewal

Premium Membership is offered on a recurring subscription basis (monthly or annual, as selected at checkout). Subscription fees are charged in advance. Your subscription will automatically renew at the end of each billing period at the then-current price unless you cancel before the renewal date. We will send a renewal reminder at least 7 days before the charge date.

7.3 Cancellation

You may cancel your Premium Membership at any time from your account dashboard. Cancellation takes effect at the end of the current billing period; you retain access to Premium features until that date. Cancellation does not entitle you to a pro-rated refund for the unused portion of the current period, except where required by applicable law.

7.4 Refund Policy

All sales are final except where required by the consumer protection laws of your jurisdiction. If you believe you are entitled to a refund under applicable law, contact us at [COMPANY_LEGAL_EMAIL] within 14 days of the charge. We will assess refund requests in accordance with applicable law and our discretion.

7.5 Price Changes

We reserve the right to change subscription prices. You will be notified of any price change at least 30 days before it takes effect. Your continued subscription after that date constitutes acceptance of the new price.

7.6 Suspension & Termination Effect

If your account is suspended or terminated for a violation of these Terms, your Premium Membership will be cancelled immediately without refund.

8.1 Ownership of Your Content

You retain all intellectual property rights in the Content you upload to the Platform. We do not claim ownership of your photographs, text, or other material.

8.2 Licence Grant to Us

By uploading Content to the Platform, you grant [COMPANY_NAME] a worldwide, non-exclusive, royalty-free, sub-licensable licence to host, store, reproduce, display, adapt, and distribute that Content solely for the purposes of operating, promoting, and improving the Platform. This licence continues for as long as the Content remains on the Platform and terminates when you permanently delete the Content or close your account, subject to reasonable caching and backup retention periods.

8.3 Platform Intellectual Property

The Platform itself — including its software, design, trademarks, logos, and all content not contributed by users — is owned by [COMPANY_NAME] or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Platform without our prior written consent.

8.4 DMCA / Copyright Takedown

If you believe that Content on the Platform infringes your copyright, please send a written notice to [COMPANY_LEGAL_EMAIL] including: (a) identification of the copyrighted work; (b) identification of the allegedly infringing material with sufficient detail for us to locate it; (c) your contact information; (d) a statement that you have a good faith belief that the use is not authorised; (e) a statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorised to act on their behalf. We will process valid notices in accordance with the DMCA and equivalent legislation. See our separate DMCA Policy for full details.

9.1 Directory / Advertising Platform Only

Models Around Me is an advertising directory and intermediary platform. We are not a party to any transaction, agreement, or interaction between Models and Visitors. We do not represent, employ, manage, or control any Model, nor do we supervise, direct, or take responsibility for any service advertised on the Platform.

9.2 No Endorsement

The appearance of a Listing on the Platform does not constitute our endorsement, verification, or recommendation of any Model, their services, their character, or their reliability. Visitors engage with Models entirely at their own risk.

9.3 No Guarantee of Legality

We make no representation or warranty that any service advertised on the Platform is legal in any particular jurisdiction. The legality of adult services varies enormously between and within countries. It is solely the responsibility of each Model and each Visitor to obtain independent legal advice regarding their local laws before advertising or engaging with any service.

9.4 Limitation of Damages

To the maximum extent permitted by applicable law, [COMPANY_NAME] shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of or inability to use the Platform, even if we have been advised of the possibility of such damages. Our total aggregate liability to you for any claim arising under or in connection with these Terms shall not exceed the greater of: (a) the total amount you paid to us in the 12 months preceding the claim; or (b) EUR 100.

9.5 Indemnification

You agree to indemnify, defend, and hold harmless [COMPANY_NAME], its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from: (a) your use of the Platform; (b) Content you post; (c) your violation of these Terms; or (d) your violation of any third-party right or applicable law.

10.1 Our Right to Remove Content

We reserve the right to review, edit, or remove any Content at any time and for any reason, including but not limited to Content that violates these Terms, Content that we determine in our sole discretion to be harmful, offensive, or unlawful, or Content that is the subject of a valid takedown notice.

10.2 Suspension & Termination

We may suspend or permanently terminate your account at any time, with or without notice, for any violation of these Terms. Severe violations — including any Content involving minors or human trafficking — will result in immediate termination, reporting to law enforcement, and a permanent ban without possibility of appeal.

10.3 Appeal Process

If your account is suspended or Content is removed for reasons other than those in the preceding paragraph, you may submit an appeal within 14 days of notification to [COMPANY_LEGAL_EMAIL] with the subject line “Content Appeal”. Include your account details, a description of the Content in question, and your reasons for appealing. We will respond within 14 business days. Our decision on appeal is final.

10.4 No Monitoring Obligation

We are not obligated to pre-screen or continuously monitor Content. However, we actively encourage users to report Content that violates these Terms using the reporting tools available on the Platform.

11.1 Governing Law

These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of [JURISDICTION], without regard to its conflict of law provisions.

11.2 Informal Resolution

Before initiating formal proceedings, you agree to first contact us at [COMPANY_LEGAL_EMAIL] and attempt to resolve the dispute informally. We will make a good-faith effort to resolve any complaint within 30 days.

11.3 Binding Arbitration

If a dispute cannot be resolved informally, you and [COMPANY_NAME] agree to resolve it through binding individual arbitration administered under the rules of a recognised arbitral institution in [JURISDICTION], rather than in court. The arbitrator’s decision shall be final and binding and may be entered as a judgement in any court of competent jurisdiction.

11.4 Class Action Waiver

You and [COMPANY_NAME] waive any right to participate in a class action, class arbitration, or other representative proceeding. All disputes must be brought on an individual basis.

11.5 Exceptions

Nothing in this section prevents either party from seeking urgent injunctive or other equitable relief in a court of competent jurisdiction to protect intellectual property rights or prevent imminent harm. This section does not apply where prohibited by the mandatory laws of your country of residence, in which case local law governs.

The Platform operates globally and may be accessed from jurisdictions with different legal requirements regarding adult content, advertising, and online services.

Each user — whether a Model or a Visitor — is solely and exclusively responsible for ensuring that their access to and use of the Platform, and any services advertised on the Platform, complies with all laws and regulations applicable in their own jurisdiction.

We make no representation, warranty, or guarantee that: (a) the Platform or its content is appropriate, available, or lawful in your jurisdiction; (b) any service advertised is lawful where you intend to receive it; or (c) the Platform meets the legal requirements of any country other than those in which [COMPANY_NAME] is incorporated and operates.

If you access the Platform from outside [JURISDICTION] you do so at your own initiative and risk, and you are responsible for compliance with local laws. We reserve the right to restrict or block access from any jurisdiction where we determine, in our sole discretion, that the Platform cannot legally operate.

Users in the European Union benefit from applicable EU consumer protection and data protection laws to the extent required. Nothing in these Terms limits rights you may have under mandatory applicable law.

We may update these Terms at any time to reflect changes in our services, technology, applicable law, or business practices. When we make material changes we will:

• Update the “Last updated” date at the top of this page.
• Display a prominent notice on the Platform and/or send an email notification to registered Models at least 14 days before the changes take effect (except where changes are required immediately by law or to address an urgent safety concern).

Your continued use of the Platform after the effective date of any revised Terms constitutes your acceptance of those changes. If you do not agree to the revised Terms you must stop using the Platform and, if applicable, cancel your Premium Membership before the changes take effect.

14.1 Severability

If any provision of these Terms is held by a court or arbitrator of competent jurisdiction to be invalid, unlawful, or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.

14.2 Entire Agreement

These Terms, together with the Privacy Policy, Cookie Policy, and DMCA Policy, constitute the entire agreement between you and [COMPANY_NAME] with respect to the Platform and supersede all prior agreements, representations, and understandings of any kind.

14.3 No Waiver

Our failure to enforce any right or provision of these Terms shall not be construed as a waiver of that right or provision. A waiver of any particular breach does not constitute a waiver of any subsequent breach.

14.4 Assignment

We may assign or transfer our rights and obligations under these Terms in connection with a merger, acquisition, or sale of assets. You may not assign or transfer any of your rights or obligations under these Terms without our prior written consent.
